NAMSON Digital Mobile Game Terms of Service (EULA)


This is a binding legal agreement between you and NAMSON Digital Company Limited.

1. Acceptance of Terms

These Terms of Service, along with our Privacy Policy, form a legally binding agreement ("Agreement") between you and NAMSON Digital Company Limited ("NAMSON Digital," "we," "us," or "our") concerning your use of our mobile games, applications, and related services (the "Service" or "Game").

By downloading, installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

1.1. Age Restriction

The Service is not directed to children under the age of 13. By accepting these Terms, you represent that you are at least 13 years old. If you are between 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms.
 

2. Limited License and Access

2.1. Grant of License

NAMSON Digital grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Service for your personal, non-commercial entertainment use, subject to your compliance with these Terms.

2.2. License Restrictions

You agree not to do the following:

  • Sell, rent, lease, share, or sublicense the Game or your account to any other person.

  • Reverse engineer, decompile, disassemble, or modify the Game source code or any part thereof.

  • Use any unauthorized third-party software, bots, cheats, mods, hacks, or automated tools designed to modify or interfere with the Game's operation or network traffic.

  • Interfere with or disrupt any NAMSON Digital server or network used to support the Game.
     

3. Account Information and Security

3.1. Account Creation

When you create an account, you agree to provide accurate and complete information. You are solely responsible for all activity under your account.

3.2. Authentication

As described in our Privacy Policy, we rely on third-party platform authentication services (e.g., Apple Game Center, Google Play Games, or other social login services) to create and manage your user account and ID. You are responsible for maintaining the security of those third-party accounts.

3.3. Account Suspension and Termination

NAMSON Digital reserves the right to suspend, terminate, modify, or delete your account at any time for any reason or no reason, with or without notice to you, including if you violate these Terms or if your account is inactive for a continuous period of 180 days.
 

4. Virtual Items and Currency

4.1. License, Not Ownership

The Service may include virtual currency (e.g., coins, gems, credits) or virtual items (e.g., skins, characters, boosters). You acknowledge that you do not own these virtual items or currency. Instead, you are purchasing a limited, revocable license to use them within the Game.

4.2. No Monetary Value

Virtual items and currency have no monetary value and cannot be redeemed for cash, property, goods, or services of monetary value from NAMSON Digital or any other party.

4.3. Refunds

All purchases of virtual items and currency are final and non-refundable, except as required by applicable law or the policies of the platform provider (e.g., Apple App Store or Google Play Store).
 

5. User Content and Code of Conduct

5.1. User Content

"User Content" means any communications, images, sounds, and all the material, data, and information that you upload or transmit through the Service. You retain ownership of your User Content, but you grant NAMSON Digital a worldwide, perpetual, royalty-free, transferable, and sublicensable right to use, reproduce, modify, and display your User Content in connection with the operation of the Game.

5.2. Code of Conduct

You agree not to transmit any User Content or engage in any behavior that is:

  • Unlawful, harmful, threatening, abusive, harassing, or defamatory.

  • Obscene, sexually explicit, or racially/ethnically offensive.

  • Infringing upon the intellectual property or proprietary rights of others.

  • Spamming, phishing, or distributing viruses or malware.

NAMSON Digital has the right, but not the obligation, to monitor and remove User Content we deem inappropriate.
 

6. Updates and Modifications

NAMSON Digital reserves the right to change, modify, update, or discontinue the Service, or any part thereof, at any time without liability to you. This includes performing maintenance, adding or removing features, or changing the Game's technical specifications.
 

7. Disclaimers and Limitation of Liability

7.1. Warranty Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. NAMSON Digital expressly disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

7.2. Limitation of Liability

NAMSON DIGITAL SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, arising out of or in connection with these Terms or your use of the Game. Our total aggregate liability to you for any and all claims related to the Service is limited to the amount you have paid to NAMSON Digital for the Service during the six (6) months immediately preceding the date of the claim.
 

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of laws principles.

You agree that any claim or dispute you may have against NAMSON Digital must be resolved exclusively by a court located in Bangkok, Thailand, except as otherwise agreed by the parties.
 

9. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Game or by other reasonable means. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
